Terms of use

In case of doubt, the French version of these Terms of Use shall prevail.
INTRODUCTION
These General Conditions of Use ("Conditions"), which are governed by Swiss law, regulate the use of services and functionalities ("Services") accessible on the various websites, apps, branches, and other information channels ("Sites") published by ManpowerGroup SA, Rue du Sablon 2, 1110 Morges, Switzerland ("ManpowerGroup", "we", "us" or "our").
These Terms also extend to the use of the Sites and Services of ManpowerGroup's affiliated companies ("Affiliated Companies"), including, without limitation and subject to change, the following entities:

THESE TERMS AND CONDITIONS constitute a binding contract between you and ManpowerGroup. By accessing or using the Sites AND SERVICES, you agree to be bound by and comply with these Terms without reservation or exception.
Our Sites are accessible to all. However, we recommend the use of our Sites and their Services only by (i) adults enjoying their full legal capacity, to the exclusion of minors subject to the prior agreement of the persons holding parental authority over them, and (ii) legal entities with the express agreement of their legal representative.
Please read these terms and conditions carefully before using our Sites and Services. If you do not agree to these terms, you must not access or use our Sites and Services.
Art. 1 ACCESS TO SERVICES
The Sites and Services offered may only be used in accordance with ManpowerGroup's intended use. In order to access and use the Services, you may be asked to complete mandatory fields marked as such. ManpowerGroup reserves the right to delete any registration containing incomplete or incorrect information.
By using the Services, you warrant that you will not upload, post or otherwise publish any information that is offensive, illegal or otherwise likely to infringe the rights, harm or threaten the safety of any person. You are entirely responsible for the information and content that you transmit to ManpowerGroup via the Services and you undertake to ensure that such information and content is accurate and kept up to date. You certify that you are the author of the content exchanged, that you do not usurp the identity of others, that you do not use a false e-mail address, and that you do not infringe the intellectual property rights of ManpowerGroup or third parties. ManpowerGroup reserves the right to take any legal action it deems appropriate in the event of identity theft, infringement of intellectual property rights, or any other criminal offence committed in connection with the use of the Services.
To access our Services, you must have the necessary equipment and Internet connection, if applicable, to mobile telecommunication networks. You are responsible for keeping all software up to date to ensure the proper functioning of your devices. You are solely responsible for access costs. If you use a third party's equipment to access our services, you warrant that you have obtained their prior consent.
ManpowerGroup strives to harmonize the management of its interfaces, however, certain Services or functionalities may only be available on one or other of the Sites.
Art. 2 PRESENTATION OF SERVICES
2.1 HR SERVICES / COMPANY
ManpowerGroup offers companies the following services:
recruitment of employees, particularly on permanent, fixed-term and temporary contracts;
Staffpool® ;
payrolling ;
interim management ;
skills assessment and development, digital solutions ;
training ;
career transition and HR support, JobCenter ;
recruitment solution in numbers/complexity (RPO) ;
managed Services Provider (MSP) ;
HR consulting ;
assessments ;
coaching.

2.2 HR SERVICES / CUSTOMER AREA
If you are a ManpowerGroup client, you may have access to digital recruitment, assignment and temporary staff management and HR dematerialization services that may be offered by third-party partners. Access to these services may be subject to the terms of use established by these partners and you may be asked to provide specific information in order to benefit from these services and functionalities.
You have access to the following services:
"TalentSight", temporary work management software developed by our third-party partner ;
management of your online orders (selection and tracking of candidates, assignment planning, tracking of temporary staff, management of your own pool, etc.);
management of your contracts and assignments (contract management, timesheets and invoicing, assignment evaluation, etc.);
management of your activity reports (activity tracking, report customization, etc.).
2.3 APPLICATION SERVICE / CANDIDATE PORTAL
Our candidate portals offer services without the need to create a personal account. Without a personal account, you will be able to :
search for job offers;
consult our candidate tips;
apply for jobs;
receive job offers.
You can apply for a job as a visitor by first filling in the required information. You can then complete your application by uploading your documents (CV, etc.) or by importing a profile from a social network of your choice (e.g. LinkedIn, Facebook or Google).
By finalizing your application, you become part of our candidate pool. After informing you, ManpowerGroup may share with clients who have positions or projects available and who may be interested in your profile the relevant information that you have provided to us at the time of your application, in particular your CV.
If necessary, the information required for the application can be uploaded to the customer's job portal, following the recruitment process established by the customer and under the latter's responsibility.Formularbeginn
ManpowerGroup may contact you to present job and project opportunities, or to provide you with relevant information via e-mail, SMS, telephone and/or other communication channels, as appropriate.
You may request the removal of your file from our candidate pool at any time by following the procedure for exercising your rights set out in our Privacy Notice, which is accessible in the footer of our websites.
2.4 APPLICATION SERVICE / PERSONAL APPLICANT AREA
To access this service, you must first create a free personal online account via the portal of your choice, and for this purpose, have a valid e-mail address or use a social network (LinkedIn, Facebook or Google, where applicable). The e-mail address you provide will be verified during the creation process, and the account will only be activated after this verification. You are responsible for maintaining the confidentiality of all account information, including your username, password, and any other registration information that ManpowerGroup may require to access and use this service. You are responsible for all activities that occur under your account.
You will receive confirmation of the creation of your personal account from ManpowerGroup at the e-mail address you provided when you registered. By creating this personal account, you become part of our candidate pool and you agree to receive messages or notifications relating to our Services, your account and job offers by e-mail, SMS, telephone and/or other means of communication, where applicable, until your account is deleted.
Once you have created your personal account, you will be able to :
upload and update your application file (CV, etc.);
update your profile and manage your data;
create e-mail alerts according to your preferred criteria;
save the job offers you have consulted;
consult the job tips;
apply for jobs in one click;
receive suitable job offers;
track your online applications via your dashboard.
ManpowerGroup may, after informing you, forward to clients with vacant positions or projects who may be interested in your profile, the relevant file or information, such as your CV, that you have provided to us.
You can delete your personal account yourself via your user profile management settings.
2.5 MANAGEMENT AND ADMINISTRATION DEPARTMENT / TEMPORARY
ManpowerGroup offers secure handling of all the administrative procedures involved in managing and administering temporary employees throughout their assignment.
You can benefit from the following services:
completion of administrative formalities and associated legal requirements (handling of pre-assignment documents, creation of assignment contracts, management of absences and salaries, preparation of social security statements, management of health, accident and LPP insurance cases, compliance of all tax and/or social security documents, etc.);
support for the temporary employee throughout the assignment (sending information about the assignment, validating availability, managing social security cover, safety awareness in accordance with current regulations, training, etc.).
When you are hired on a temporary work assignment, you are obliged to sign and return to ManpowerGroup the assignment contract submitted to you beforehand.
You also have the option of accessing the "Webtime" service, which is offered and managed by a third-party partner. This can be done either via the online portal, or via the dedicated mobile application. This service enables temporary employees to record their working hours, while customers can validate them and draw up electronic time reports.
2.6 TRAINING SERVICE
ManpowerGroup offers its candidates and temporary employees the opportunity to develop and maintain their professional skills through various training programs for professionals of all levels, for example via the "powerYOU" E-Learning platform published by ManpowerGroup, through the "Academy" certification program implemented by our Affiliated Companies, or through training courses offered by our commercial partners.
Please note that not all the resources offered are automatically covered by a paid training contract.
ManpowerGroup reserves the right to modify at any time the terms and conditions of access and execution of training offers.
Art. 3 PROTECTED RIGHTS
3.1 MANPOWERGROUP CONTENT
The Sites, including text, audio, video, graphics, tables, photographs, interfaces, icons, software, computer code, data, trademarks, logos, slogans, documentation, other components and content, as well as the design, selection and arrangement of the content, and all intellectual property rights in the foregoing ("ManpowerGroup Content") are the exclusive property of ManpowerGroup or, where applicable, its suppliers or licensors.
When you access the Services, ManpowerGroup grants you, for the duration of this access, the rights to represent and reproduce this content on the equipment and browsers you use to access the Services. These rights are granted on a revocable, personal, non-transferable and non-exclusive basis. All other rights to the Sites and ManpowerGroup Content are expressly reserved to ManpowerGroup or its assigns.
3.2 USE OF TRADEMARKS
ManpowerGroup is the owner of certain trademarks, names, logos, insignia or service marks, including, but not limited to, ManpowerGroup®, Manpower®, Manpower Staffpool®, Experis®, Talent Solutions ManpowerGroup®, the ManpowerGroup logo ("Marks"). You do not have the right to use the Marks, except with the express written consent of ManpowerGroup. In addition, the Sites may contain third-party trademarks and copyrighted materials, which are the property of their respective owners. Nothing in these Terms grants you any rights to such third party trademarks or materials without the consent of the third party.
3.3 INTELLECTUAL PROPERTY RIGHTS
ManpowerGroup Sites and Content are protected by copyright, trademark and other intellectual property laws. Any unauthorized use of any trademark, trade dress, copyrighted material or other intellectual property belonging to ManpowerGroup or any third party is strictly prohibited and may be prosecuted to the fullest extent of the law.
Art. 4 NAVIGATION
Before connecting to the Services, it is your responsibility to check that your equipment allows you to access them in a secure environment. Likewise, before using the Services, we recommend that you ensure that the cache memory of your equipment or browser has been cleared, in order to ensure that any pages or content accessible are up to date. ManpowerGroup reserves the right to improve, modify or withdraw all or part of the functionalities or Services, at any time and for any reason whatsoever. We encourage you to download and install all updates to the Services, including applications.
4.1 CONNECTION AND USE
When you access ManpowerGroup Services, certain data about you may be automatically collected. This includes technical data related to the use of the Services, such as the IP address of your equipment, the type of connection, the IP address of your Internet service provider, the date and time of access to the Services, the address of the website from which you were redirected to the Services, the operating system you are using, the pages you visit, the number of feature activations in the Services, the type of equipment you are using, as well as the version number of our Services you are using. This data may be used for purposes of administration, improvement and security of our Services.
You are informed that in order to use certain functionalities, in particular on websites and applications, it may be necessary to use geolocation data, in particular the geographical location of your mobile device. You accept this use if you wish to access these features.
4.2 COOKIES AND SIMILAR TECHNOLOGIES
When accessing and using the Services, in particular the Sites, information may be temporarily stored in the memory or on the hard disk of your device, in particular by means of cookies or other similar technologies such as web beacons or web server logs.
These cookies are used for the following purposes:
identification and access to the Service(s) of the Sites;
facilitating navigation on the Sites;
site administration;
audience analysis;
sharing content on your social networks;
functional statistics.
You can restrict or disable the storage of these cookies at any time using your browser's privacy settings. Please note that refusing all cookies may restrict access to all or part of the functionalities of the Services offered.

4.3 THIRD-PARTY LINKS, SITES AND SERVICES
ManpowerGroup may propose or present on the Sites links or interfaces to third-party sites, applications or services. These links are established in agreement with the third parties concerned at a time when ManpowerGroup has deemed it appropriate to do so, taking into account the content and services offered by these third parties.
ManpowerGroup neither publishes nor controls the sources or content of these sites, nor their links to other sites. The presence of a link or reference to another site or third-party service in no way implies that ManpowerGroup approves, validates or adheres to the content of these sites or the services offered, nor that it is associated with the owners, authors, publishers, designers, administrators, managers or hosts of these sites or services. It is your responsibility to use such information and references with discernment and a critical mind, and to inform yourself of the conditions of use or commercialization of such third-party sites, content or services.
ManpowerGroup cannot be held responsible for the content, products, services, advertising, cookies and similar technologies, or any other element of these sites or services, nor for any actual or alleged damage or loss, direct or indirect, resulting from or related to the use of information, opinions, services, or data available on these sites or services.
Art. 5 LIABILITY
ManpowerGroup, its affiliates and each of its officers and employees ("members of ManpowerGroup"), SHALL NOT BE HELD LIABLE FOR ANY DIRECT OR INDIRECT DAMAGES OF ANY KIND AND TYPE, RESULTING FROM OR RELATED TO ANY CONNECTION, ACCESS TO AND/OR USE OF THE SITES AND/OR ANY SERVICE.
ManpowerGroup, on behalf of its own parties, does not guarantee that the Sites or Services offered will meet your needs and expectations.
5.1 CONFIDENTIALITY OF IDENTIFIERS
In order to access certain Services, ManpowerGroup may provide you with identifiers and access codes necessary for your connection ("Identifiers"). These Identifiers are strictly personal, non-transferable and confidential.
Access to and use of the Services, as well as all actions carried out using your Identifiers, shall be deemed to have been carried out on your behalf. You undertake not to transmit or disclose your Identifiers to any third party. You remain entirely responsible for the use of these Identifiers and you undertake to take all necessary measures to guarantee and preserve their confidentiality. ManpowerGroup cannot be held responsible for the use of the Sites and Services by a third party in possession of your Identifiers.
You agree to (i) immediately notify ManpowerGroup of any unauthorized use or knowledge of your Identifiers by a third party and the cause of such unauthorized use or knowledge, and (ii) cooperate with ManpowerGroup to put an end to such unauthorized use or knowledge.
If ManpowerGroup has reason to suspect misuse or non-conforming use of the Identifiers, or if there is a breach of these Terms, or more generally to guarantee the security of the Services, ManpowerGroup reserves the right, at any time, without notice and without prior action, to suspend and/or delete any Identifier, or even to revoke access to the Sites and Services without this giving rise to any right to compensation for any loss, including loss of profits, business or opportunities that you may incur. ManpowerGroup reserves the right, however, to inform you of the measures taken and the consequences for you.
5.2 SERVICE CONTENT
The information and data available on the Sites are provided for information purposes only and should under no circumstances be construed as legal or operational advice. Furthermore, ManpowerGroup cannot be held liable in any way whatsoever for such information and data.
The Services may also give you access to various information and data, in particular news on human resources, the economy, ManpowerGroup, assignment and job offers, as well as information on temporary work regulations and, more generally, on employment law. ManpowerGroup in no way guarantees the accessibility, relevance, updating or exhaustiveness of the information provided. ManpowerGroup cannot be held responsible for the information, suggestions or content provided, nor for decisions taken on the basis of or under the influence of such information, nor in the event of the Sites being unavailable, particularly during maintenance periods.
It is important to note that the information provided on the Sites concerning assignments does not constitute a contract of employment or a promise of a contract of employment.
We remind you that there are inherent risks in the electronic transmission of information. Delays, omissions or inaccuracies may occur. The information accessible via the Services is provided as is, regardless of its source.
5.3 CONFIDENTIALITY OF COMMUNICATIONS VIA THE INTERNET AND OTHER NETWORKS
Insofar as communications via the Internet and other telecommunications networks (in particular
when accessing via any mobile connectivity equipment) are, by default, not secure, ManpowerGroup cannot be held responsible for any interception, whether intentional or accidental, by a third party, of any message and/or information exchanged between you and ManpowerGroup.
5.4 AVAILABILITY
The Services are in principle accessible 24 hours a day, 7 days a week, except in the event of interruption, whether planned or not, for maintenance or updating purposes or in the event of force majeure. ManpowerGroup has a best-efforts obligation and cannot be held liable for any damage whatsoever resulting from the unavailability of the Services.
5.5 PROOF AGREEMENT
ManpowerGroup and you agree to define, in the context of the Services, the rules relating to admissible evidence in the event of a dispute and their evidential value. The following provisions constitute the evidentiary agreement between you and ManpowerGroup.
The computerized registers kept in ManpowerGroup's systems, in accordance with industry security standards, will be considered as proof of communications by e-mail, the sending of registration forms, the downloading of documents, acceptances, subscriptions to services and the placing of orders. Such information and documents are archived on a medium that guarantees the fidelity and durability required by current legal provisions. In the event of any discrepancy between our computerized records and any other document, regardless of its form (paper, electronic or other), in your possession, ManpowerGroup's computerized records shall prevail.
Art. 6 PERSONAL DATA
By using the Sites, the Services and your personal account, you expressly agree that ManpowerGroup may collect, use, share and process the data collected, including but not limited to personal information about you, in connection with the performance of this contract. The collection and use of your personal data is carried out in accordance with the Privacy Notice and the Cookie Policy, which are available in the footer of our websites, which you may consult to become acquainted with them.
Our information notices explain what personal data we collect through our Sites, Services and your account, why we collect it, how we use it, how we share it and how you can exercise your data protection rights.
ManpowerGroup collects and processes your personal data in particular for the following general purposes:
As a candidate, we use your data to :
create and manage your user account on our Sites;
contact you in order to present you with job opportunities and projects, or to pass on any relevant information via e-mail, SMS, telephone and/or other communication channels, as appropriate;
process your applications and provide you with follow-up information ;
assess the relevance of your skills and professional experience;
forward relevant information about you to customers who have positions or projects available and may be interested in your profile;
offer you training and skills development services;
offer you career management and transition services, support and coaching.
As a temporary worker, we use your data to :
keep you informed about your current and future assignments and manage them;
take charge of the documents prior to the mission;
draw up assignment contracts in compliance with current regulations;
execute assignment contracts and carry out related administrative formalities;
manage your availability and absences ;
draw up salary and social security contribution statements;
pay your salary;
manage external service providers such as insurance companies, pension funds, etc. ;
comply with our legal, regulatory and collective bargaining obligations;
evaluate your satisfaction in order to improve the quality of our services and products;
offer you training and skills development services.
As a customer or prospect, we use your data to :
provide you with our services and products;
ensure the follow-up and management of our commercial relations, and exchange with you;
draw up contracts in compliance with current regulations;
perform the contracts entered into between you and ManpowerGroup;
comply with our legal, regulatory and collective bargaining obligations;
keep you informed about ManpowerGroup and its services and products;
evaluate your satisfaction in order to improve the quality of our services and products;
invite you to take part in promotional operations or events.
You may refer to our information notices, which are easily accessible in the footer of our websites, to obtain a thorough understanding of the purposes of our data processing as well as our data protection practices. ManpowerGroup reserves the right to update our information notices at any time, in particular to ensure our compliance with current legal provisions.
You are reminded that you have the option of directly configuring certain uses of your data in your personal account. Any changes you make to these settings will be taken into account as soon as possible.
If you choose not to provide certain required personal data, our ability to provide you with the services you have requested may be affected.
ManpowerGroup implements security policies, procedures and measures to adequately protect your personal data against loss, destruction, unauthorized use or disclosure.
In accordance with applicable data protection provisions, you may exercise your rights by using the management settings in your user profile in certain cases, or by following the procedure for exercising your rights, indicated in our Privacy Notice which is accessible in the footer of our websites.
6.1 DATA RETENTION PERIOD
Your data will be kept for as long as is necessary to fulfil the purposes for which it was collected or to comply with legal, regulatory or internal policy requirements. We observe the following general retention principles, from which we may however derogate in particular in the case of specific data processing:
the data of candidates without an assignment or placement will be kept for a period of 3 years from the last contact;
temporary worker data will be kept for 10 years from the last salary statement (end of the accounting year in which the document was created);
the data of non-customer prospects will be kept for a period of 5 years from the last contact;
data relating to customer contacts, or their representatives and agents, will be kept for a period of 10 years from the end of the commercial relationship.
6.2 DATA TRANSFER
Personal data will only be processed for the purposes and to the extent necessary for the performance and execution of these Conditions. To this extent and for these purposes, ManpowerGroup may also transfer personal data to ManpowerGroup Affiliates as well as to service providers and other third parties commissioned by ManpowerGroup in Switzerland or abroad, including in third countries that do not offer an adequate level of protection, provided that the requirements imposed by applicable data protection laws and regulations are complied with.
Art. 7 JURISDICTION AND APPLICABLE LAW
These Terms, as well as your access to and use of our Sites and Services, are governed by Swiss law. Any dispute arising out of or in connection with the validity, interpretation or performance of the Terms shall be subject to the jurisdiction of the Swiss courts.
Art. 8 MODIFICATIONS
ManpowerGroup may, at its sole discretion, revise these Terms from time to time, in particular when new Services and/or functionalities are added. The most recent version of these Terms will be made available on the Sites. The effective date of the Terms is indicated in the header. In the event of material changes, we will notify you via our Sites, your account, e-mail or other means of communication, as appropriate.
By continuing to access or use the Sites and Services after such modifications become effective, you agree to be bound by the revised Terms. If you do not accept the revised Terms, you must stop using the Sites and Services. In this case, you have the option of deleting your personal account yourself via the management settings of your user profile, or of requesting the deletion of your personal data by following the procedure for exercising your rights set out in our Privacy Notice, which is accessible in the footer of our websites.
